3. DEFINITIONS

Unless the context otherwise requires:

• “Processing” includes any operation performed on personal data, whether by automated or manual means.
• “Controller” refers to the Agency that determines the purpose and means of processing personal data.
• “Processor” means any third party that processes personal data on behalf of the Controller.

4. LAWFUL BASIS FOR PROCESSING

The Agency shall process personal data only where a lawful basis exists, including:

• The express, informed, and unambiguous consent of the Data Subject;
• The necessity of processing for the performance of a contract to which the Data Subject is a party;
• Compliance with a legal obligation imposed by statute or regulatory directive;
• The pursuit of the Agency’s legitimate interests, provided such interests do not override the fundamental rights and freedoms of the Data Subject.

• Appropriate safeguards are implemented, including standard contractual clauses and binding corporate rules;
• The transfer complies with Sections 41–43 of the NDPA.

9. DATA RETENTION

Personal data shall be retained only for the duration necessary to fulfill the purpose of collection or as required by law. Upon expiration of the retention period, data shall be securely deleted or anonymized in accordance with Section 44 of the NDPA.

10. RIGHTS OF DATA SUBJECTS

Data Subjects are entitled to the following rights under the NDPA:

• Right of access to personal data
• Right to rectification of inaccurate data
• Right to erasure (“right to be forgotten”)
• Right to object to processing
• Right to data portability
• Right to lodge a complaint with the Nigeria Data Protection Commission (NDPC)
